These Terms of Service set out the rules that apply when you use the website of Duran Capital Properties LLC, request a marina quote, lease a slip, book a haul-out, store a hull for the winter or take part in a fuel dock audit. They are written in plain language and should be read in full before you enter into an agreement with us.

The company operates a lake marina quoting desk at Duran Capital Properties LLC, 457 S 3000 W, Syracuse - 84075-9715, United States (US). You can reach the office by email at quotes@durancapital.lol or by telephone at +17312700428.

If you do not agree with these terms, please do not use the website or request a quote. If you have already asked for a quote and have a question about a term, contact the office before you sign a lease or confirm a schedule.

These terms apply to every visitor and every customer. The privacy policy explains how personal information is handled and should be read together with this page.

1. Acceptance of These Terms

By visiting this website, sending a message through the contact form, telephoning the office or accepting a written quote, you confirm that you have read and accept these Terms of Service. Acceptance may be given by clicking a submit button, by replying to an email quote, by signing a lease or by paying a deposit for a scheduled service.

If you accept these terms on behalf of a company, a club or another person, you confirm that you have authority to bind that party. Where a vessel is owned by more than one person, the person who accepts the terms is responsible for sharing them with the other owners.

These terms apply together with any written lease, docking agreement, storage agreement or schedule confirmation that covers a specific vessel. If a signed agreement conflicts with these terms, the signed agreement controls for the matter it addresses.

2. About the Company

Duran Capital Properties LLC is a company registered in the United States with its office at 457 S 3000 W, Syracuse - 84075-9715, United States (US). The business works within computer systems design and related professional, scientific and technical services. The marina desk applies that systems discipline to slip quoting, dockage rate cards and yard scheduling.

References in these terms to the company, we, us or our mean Duran Capital Properties LLC. References to the office mean the Syracuse marina office at the address above. References to the marina mean the pier, bays, yard, lift and fuel dock operated in connection with the quoting service.

The office hours are Monday to Friday from 8:00 to 17:00, and Saturday from 9:00 to 13:00 by appointment. Messages received outside these hours are handled on the next working day. The office is closed on Sunday and on public holidays observed in New York.

3. Marina Quoting Services

The company provides six kinds of marina service. Each is described on the services page of this website, and each is delivered from the Syracuse marina office.

3.1 Slip lease bays

Slip lease bays are quoted by bay letter, season and measured hull fit. The quote names the depth and clearance at the berth, the power available and any condition that affects access.

3.2 Dockage rate runs

Dockage rate runs set the length bands, seasonal steps, power surcharge and walkway fee on one dated card. A rate run is valid for the period stated on the card and is replaced when a rate changes.

3.3 Haul-out schedule desks

Haul-out scheduling blocks the lift, the cradle and the yard crew together. A schedule confirmation states the arrival time, staging area and cradle number for the vessel.

3.4 Lift inspection windows

Lift inspection windows cover the slings, spreader bar and keel blocks before a hull is lifted. The result is logged with a time, an inspector name and any note that affects the lift.

3.5 Winter storage reviews

Winter storage reviews compare the intake record with the condition of the vessel at launch. The review may include photographs, cradle notes and recommendations for the next season.

3.6 Fuel dock audits

Fuel dock audits compare the posted board rate, the pump meter reading and the day receipts. The audit report is kept on file and can be reviewed on request by a customer who bought fuel on the audited day.

We may decline a request that is outside our competence, that cannot be completed safely or that would conflict with an existing booking. Where we decline, we will explain the reason and, where possible, point you to a suitable alternative.

4. Quotes and Estimates

A marina quote is prepared from the details you provide and from the measurements recorded on our slip map. A quote is an offer to provide the described service on the described terms for the period stated. It is not a guarantee that a berth, a lift window or a storage position will remain open until you accept it.

4.1 Accuracy of details

You are responsible for the accuracy of the hull length, beam, draft, weight and power demand you provide. If a measurement turns out to be different at the pier, we may revise the quote, move the vessel to a more suitable bay or cancel the booking if the vessel cannot be handled safely.

4.2 Validity period

Each quote states how long it remains valid. A quote that has expired may be reissued at the current rate card. Rates are reviewed at the start of each season and when the cost of a service changes during the season.

4.3 Changes requested by you

If you ask to change a bay, a lift date or a storage position after a quote is issued, the office will prepare a revised quote. A change may affect the rate and may affect the availability of a date. We will confirm in writing before the change takes effect.

4.4 Changes required by safety

Where a lift or a berth arrangement must change for safety reasons, we will contact you as soon as possible and explain the reason. Safety changes are not treated as a breach of these terms.

5. Slip Leases

A slip lease gives you the right to use a named bay for the period set out in the lease. The lease does not transfer any ownership interest in the pier, the dock or the water area. Access to the pier is for the vessel named in the lease and for the people who crew it.

5.1 Berth use

A berth may be used only by the vessel described in the lease. If you replace the vessel, move to a different hull or lend the berth to another person, you must tell the office in writing. We may require a new quote or a new lease.

5.2 Subletting

You may not sublet a berth or charge another person for its use without written permission from the office. Unauthorized use by a third party may lead to the lease being suspended.

5.3 Conduct at the pier

You must keep the walkway clear, secure lines and fenders so the vessel does not touch the structure, and keep the area around the berth free of rubbish. Fuel, oil and cleaning products must be handled so that nothing enters the water.

5.4 Liveaboard use

Living aboard a vessel at the marina requires written approval and may be subject to additional terms. Sleeping aboard overnight for a short visit does not require approval, provided the vessel is operated and insured under this agreement.

6. Haul-out and Launch Scheduling

Haul-out and launch dates are booked against the yard calendar, the tide and the availability of the lift. A schedule confirmation is issued for each booking and states the date, the arrival window and the staging area.

You must arrive within the stated arrival window. If a vessel arrives late, the lift may be reassigned to the next booking and the haul-out moved to the next open slot. If a vessel arrives with equipment that cannot be secured safely, the lift will wait until the issue is corrected.

Launch dates depend on the completion of any yard work and on the weather. We will confirm a launch date in writing and will contact you if the date has to move. A moved date does not entitle you to a refund of a prepaid berth fee, because the berth remains available for the vessel.

You are responsible for removing personal property, loose gear and valuables before a haul-out. Items left aboard are handled as described in the storage section of these terms.

7. Lift Inspections and Yard Safety

Every lift begins with an inspection window. The yard crew checks slings, straps, the spreader bar and the keel blocks before the hull is lifted. The inspection is recorded in the berth file with the time, the inspector name and any note that affects the lift.

If an inspection finds a defect, the lift is delayed until the defect is corrected. A delay caused by a defective sling or a damaged block is not a breach of these terms, and the reason will be logged for the customer.

Only yard crew and authorized visitors may enter the work area during a lift. Customers must stay behind the marked line unless a crew member invites them forward. Photographs may be taken from the public side of the line, but not from beneath a suspended vessel.

Lifting points and attachment hardware on the vessel are the responsibility of the owner. If you are unsure whether a fitting is strong enough for a lift, ask the crew before the inspection begins.

8. Winter Storage

Winter storage at the marina is provided on a cradle or by arrangement with a yard stand. The intake record notes the cradle fit, the cover plan and the fluid and battery steps that will be taken. The review at launch compares that record with the condition of the vessel.

8.1 Storage period

The storage period is stated in the storage confirmation. A vessel that remains in storage after the end of the period may be charged at the current monthly rate. We will contact you before the end of the period to confirm the launch date.

8.2 Vessel condition

The vessel must arrive clean and free of standing water. Fuel tanks should be managed according to the storage note provided at intake. Food, bait and other perishable items must be removed before the cover is fitted.

8.3 Access

You may visit a stored vessel during office hours with a member of the yard staff. Access to the storage area without an escort is not permitted for safety reasons. Persistent covers may need adjustment during a visit and a crew member will fit them again before you leave.

9. Fuel Dock Audits

The fuel dock audit compares the posted board rate, the pump meter reading and the day receipts. Where an audit finds a difference, the office records the cause and the correction. The dock staff are informed before the next sale is made.

A customer who believes a fuel charge is wrong may ask for the audit record for the day of the purchase. We will compare the receipt with the posted rate and with the meter reading and will explain the result. Where a correction is due, it is applied to the account promptly.

The audit does not replace the customer duty to check the pump display before fueling and to confirm the amount on the receipt. Please report a suspected meter fault to the dock staff before you leave the fueling position.

10. Fees and Payment

Fees for slip leases, haul-out work, storage and inspections are set out in the quote or lease. A deposit may be required to hold a berth or a lift window. The balance is due on the schedule stated in the document.

10.1 Payments

Payments must be made by the method stated on the invoice. The office will explain the available methods, and will never request card numbers or bank credentials by email. Please do not send such details through the contact form.

10.2 Late payment

An account that is overdue may be subject to a late charge allowed by law and to a pause in non urgent scheduling. We will send a written reminder before taking any step that affects access to a berth.

10.3 Refunds

A deposit is refundable if a booking is cancelled within the period stated in the quote. A service that has already been performed is not refundable. Where a service cannot be performed for a reason within our control, we will offer a replacement date or a refund of the amount paid for that service.

11. Customer Obligations

To keep the marina safe and the schedules accurate, you agree to the following obligations.

  • Provide accurate hull, contact and insurance details and update them when they change.
  • Maintain the vessel in a seaworthy condition with working mooring fittings.
  • Carry valid liability insurance for the vessel and provide a certificate on request.
  • Follow the instructions of yard crew during a lift, haul-out or storage move.
  • Keep the berth, walkway and storage area tidy and free of hazardous items.
  • Report any damage to the pier, the dock, another vessel or the environment without delay.
  • Do not bring hazardous materials into the yard without prior written approval.
  • Pay invoices by the due date and cooperate with any billing question.

A breach of these obligations may lead to a correction request, a rebooking, a suspension or, in serious cases, termination of the agreement as described below.

12. Risk, Loss and Insurance

A marina involves water, weather, heavy equipment and moving vessels. The vessel and its equipment remain at the owner risk at all times. The company takes reasonable care in lifting, moving and storing vessels, but it does not insure the vessel and is not an insurer of personal property.

You should carry hull and liability insurance that covers the vessel while it is at the marina, in the yard and in storage. The policy should cover lifts and storage moves where that is available. A certificate of insurance may be requested during the season.

Personal property left on board or in the yard is not covered by the company. Valuables should be removed before a haul-out or a storage period. The company will store small items only where a written arrangement has been made.

Where loss or damage is caused by the negligence of the company or its crew, the company will address the matter through its insurance process. Please report any incident in writing within a reasonable time so the evidence can be preserved.

13. Acceptable Use of the Website

The website is provided for information and for quote requests. You agree to use it lawfully and not to interfere with its operation.

  • Do not attempt to gain access to an area of the site or an account that is not yours.
  • Do not upload malicious code, run automated scraping tools or overload the server.
  • Do not use the contact form to send spam, unlawful material or content that harms another person.
  • Do not misrepresent your identity or your connection to a vessel or an account.
  • Do not copy the site content for commercial use without written permission.

We may block access where a pattern of misuse is found and may report serious conduct to the appropriate authority.

14. Intellectual Property

The text, layout, slip map illustration, rate card format and other content on this website belong to Duran Capital Properties LLC or are used with permission. The company name, the marina desk name and the visual devices used on the site are protected in the same way.

You may read, print and keep a copy of a page for your own records and for a quote discussion. You may not publish, resell or distribute substantial parts of the content, and you may not use the company name or the site design in a way that suggests a partnership or endorsement without written permission.

If you send us a message with a suggestion, a photograph or a note about the service, you grant us permission to use it to improve the service. You keep ownership of the material you send, and we will not publish a photograph of your vessel without your consent.

15. Privacy and Data

We collect and use personal information as described in the privacy policy published on this website. That policy covers the information in a berth file, the details sent through the contact form and the technical records kept by the hosting platform.

By using the site or requesting a quote, you agree that we may process the information needed to respond to you and to deliver the service. You may ask for a copy of your information, correct a detail or request deletion as described in the privacy policy.

Please keep your own records secure. A quote or a lease that contains personal details should not be posted in a public place or forwarded to a person who has no role in the booking.

16. Limits of Liability

To the extent allowed by law, the company is not liable for indirect, incidental or consequential loss arising from the use of this website or from a marina service. This includes lost profit, lost use of a vessel, lost bookings and damage to business reputation.

Where liability cannot be excluded, the total liability of the company for a claim connected with a service is limited to the amount paid for that service in the twelve months before the claim, or to the replacement cost of the service, whichever is lower.

Nothing in these terms limits liability for fraud, for death or personal injury caused by negligence, or for any other liability that cannot lawfully be limited. Some jurisdictions do not allow a limitation on certain rights, and in those places the limitation applies only to the maximum extent permitted.

The company is not responsible for the accuracy of information published by a third party, such as a weather service, a chart provider or a municipality notice, even where a link to that source appears on our pages.

17. Events Beyond Control

The company is not in breach of these terms where a delay or a failure is caused by an event beyond reasonable control. Such events include severe weather, flooding, high water, ice, fire, a utility failure, a public health restriction, a labor dispute, a supplier failure and an act of government.

Where such an event affects a booking, we will contact the customer as soon as possible, explain the situation and offer a replacement date or a refund of the amount paid for the affected service. We will keep the berth or the storage position available where that is safe.

The customer is not required to pay for a service that could not be provided because of such an event. A deposit already paid will be applied to the replacement booking or returned in line with the refund rules above.

18. Suspension and Termination

We may suspend a service where an account is overdue, where a vessel cannot be handled safely, where an insurance certificate is missing or where conduct at the marina puts people or property at risk. A suspension is confirmed in writing with the reason and the step needed to restore the service.

We may terminate an agreement where a serious breach is not corrected within a reasonable time, where a vessel is abandoned, or where continued use would be unlawful. On termination, the customer must remove the vessel and personal property by the date stated in the notice and must settle any outstanding invoice.

You may end a lease or a storage booking by giving the notice period stated in the document. A fee already paid for a completed service is not refundable, but a prepaid amount for a future period will be handled according to the refund rules.

Where a vessel is left after termination and the owner cannot be reached, the company will follow the procedure allowed by local law, including storage notice and, where necessary, a lien process. We will make reasonable efforts to contact the owner and any registered lienholder before taking such a step.

19. Governing Law and Disputes

These terms are governed by the laws of the State of New York and by applicable federal law of the United States, without regard to conflict of law rules. The address of the company is 457 S 3000 W, Syracuse - 84075-9715, United States (US).

If a dispute arises, please write to quotes@durancapital.lol with a summary of the issue and the outcome you seek. We will review the berth file, reply in writing and try to resolve the matter within thirty days. Many questions about rates, schedules and invoices can be settled in this first step.

If the matter cannot be resolved by discussion, either party may bring a claim in a court of competent jurisdiction serving the county in which the marina office is located. Nothing in this section prevents a party from seeking urgent relief where delay would cause harm.

Where a single provision of these terms is found to be invalid, the remaining provisions continue in effect. A failure to enforce a provision on one occasion does not waive the right to enforce it later.

20. Changes to These Terms

We review these terms at least once a year and whenever a change in law or in our service requires it. When a change is material, we will update the effective date at the top of the page and, where we hold a current email address, send a short notice describing the change.

A change does not apply retroactively to a lease or a booking that has already been confirmed, unless the change is required by law or is needed for safety. The terms that applied when you signed remain the terms for that booking.

The current version is always available on this page. If you have a question about which version applies to your booking, contact the office and a staff member will confirm it in writing.
